The prices indicated on the web site are in Euros and include the VAT in force. The price of transportation varies according to the delivery address and the product purchased.

The price of each product will be established at each moment on the website. We try to ensure that all prices shown on the website are correct. If we discover that there is an incorrect price, we will notify you as soon as possible and offer you the possibility to reconfirm the order, with the correct price, or to cancel it.

In the event that you decide to cancel, the financial department will credit you the amount you have paid, by the same means by which you placed the order. If you have not made any payment, because you have selected the option Cash on Delivery or Transfer as payment method, we will simply cancel the order without any payment.

Assembly is only included in those items that specify it, in the rest the assembly is not included. In case of needing the withdrawal of the old product equivalent to those that the customer has requested in his purchase, please consult availability by phone or e-mail. If you agree to remove the old product, you must have these materials disassembled and ready for removal. This service will never remove additional bedding materials or pieces of furniture such as bed frames, footboards and headboards. In addition, these items will be discarded and will never be taken to any additional address provided by the customer.

This service can only be contracted during order placement and, under no circumstances, during delivery. Without this service, the carrier will not remove any old material that the customer has at home.

6. DELIVERY TIME

Delivery time may vary depending on the products you wish to purchase. There is the possibility of delivery in 48H, store pickup, or a standard shipment, which will vary between 3 and 15 days depending on the situation. During the purchase process you will be informed of the delivery time of your order by e-mail. We will contact you to arrange a date and time for the delivery of the product.

7. SCOPE OF SALE

The scope of sale of this website is to all peninsular Spain, for shipments to the Canary Islands, Balearic Islands and Andorra check availability. Depending on each area the price of transportation may vary, but we will always inform you before finalizing the purchase.

8. MANAGEMENT AND PROCESSING OF ORDERS

Generally LARIS DESCANSO, S.L. will process all orders placed through the web www.factorycolchon.es provided that the payment of the same is in accordance with the payment method chosen by the customer. However, we reserve the right to withdraw or modify any product or content of this website at any time.
Exceptional circumstances may occur that require us to refuse to process an order even if the order confirmation or order shipment message has been sent, and we reserve the right to do so at any time.
We shall not be liable to you or to any third party for the removal of products or content from the site, or for the modification of any material or content on the site. We will not be liable to you or to any third party for refusing to process an order, even if we have sent you the order confirmation message.

9. DELIVERY OF THE PRODUCTS

LARIS DESCANSO, S.L., without prejudice to the provisions of clause 5, and unless exceptional circumstances occur, will send orders within the time limit set out on our website, and order confirmation email you will receive when the order is completed.

The delivery time of the products may be increased due to the following circumstances:

– Customized or made-to-measure ordersIn this case we will inform the customer of the delivery time in writing and on an individual basis.

– Specific circumstances: For reasons of availability of certain items, there may be some delay of your order. If this is the case, we will inform you.

The transport service is not authorized to carry any type of merchandise up the façade or exterior of the dwelling.

Neither shall they use pulleys or similar mechanisms to lift the products along the façade or other exterior spaces of the dwelling. In this way, it is the customer’s responsibility to check that the items can access the stairs, doors and corridors of the house, as well as the correct access to the desired place of installation, provided that the product is mounted. The order will be considered as delivered when you receive it at your address. Receipt of the same implies acceptance. Carriers will usually require the signature of the person receiving the order, which is valid for the order to be considered as delivered.

10. CHANGES OR RETURNS AND RIGHT OF WITHDRAWAL

Within the first 14 days you can return or exchange your mattress as long as it is in its original packaging and has not been used. The customer will always be responsible for the return transport costs. Only mattresses that are not of special sizes, the upholstered base offer and the bed bases have the right of withdrawal. In case of manufacturing defects, LARIS DESCANSO S.L. will exchange the product for another provided that the claim is documented to info@factorycolchon.es or any other means valid in law, attaching photos or videos of the defects mentioned and enclosing the purchase invoice. In this case you will not assume any costs. In the event that the change has been accepted by LARIS DESCANSO S.L., we will give you written instructions via email on how to prepare the mattress so that the carrier can pick it up. The collection of the product will be carried out by the transport company and it is the customer’s responsibility to ensure that this can be done without incident and on the first floor of the building. To accept an exchange or return of a product, LARIS DESCANSO S.L. will ask you for photos or graphic supports in which we can observe the condition of the product. We will only accept exchanges or returns of products that are in perfect condition.

11. RIGHT OF WITHDRAWAL

In accordance with the provisions of Articles 107 and 108 of the General Law for the Defense of Consumers and Users, if you are contracting as a consumer, you may withdraw from the contract except in those cases in which the law itself indicates that due to the specialty of the product or for certain reasons, including hygiene, explicitly excludes the possibility of withdrawal.

LARIS DESCANSO S.L. informs you that you will not have the right to withdraw from the contract or to exchange the product when the object of the contract is:

  • Special size items made to order and/or exact size items.
  • Personalized items. All those in which the upholstery is chosen.
  • Bed linen that is not in its original packaging, and not unsealed.
  • Articles manufactured expressly to customer specifications.
  • Handmade mattresses.
  • Pillows.
  • Pet mattresses.

Special stocking shall mean all twin mattresses and all those sizes that are not available on our website, all sizes over 150cm wide, sizes 180cm and 200cm long, as well as sizes 80, 120 and 140cm wide. Personalized items are understood to be those in which the customer chooses aspects of the same, such as upholstery, in these cases will not have the right of withdrawal, as they are specific items manufactured exclusively for each customer.

In all other cases you may, within 14 calendar days from the date of delivery, cancel your order. The product must be in its original packaging and must not have been used.

In this case LARIS DESCANSO S.L. will refund the price paid for the products in full. The consumer shall be responsible for the cost of transporting the returned product in accordance with current regulations.

12. GENERAL WARRANTY

All products on this website have a two-year warranty against manufacturing defects from the date of receipt of the product. In the event that a product has a defect, LARIS DESCANSO, S.L. as an expert will assess its repair, replacement or refund of the amount being totally free for the customer.

You must inform us of your non-conformity within two months of becoming aware of it. LARIS DESCANSO, S.L. may request photos, videos, or other graphic media that allow the study of the product and must be attached the original purchase invoice.

Misuse of the products may invalidate the warranty. A number of maintenance tips should be taken into account.

  • Latex mattresses may not be placed on upholstered bases, tatamis, plastic slatted bed bases or other surfaces that do not allow proper ventilation.
  • Neither latex nor viscoelastic mattresses may be placed on varnished upholstered bases.
  • You may not use any mattresses supported by spring mattress bases.
  • No spring mattress can be placed on an articulated bed base, the mattresses that can be articulated will be specified in their characteristics.
  • Articulated bed bases should articulate from a completely flat position, with the sleeper lying down. Never sit on already articulated parts.
  • All bed bases support a very high weight, regardless of the number of people resting on them. For bed bases up to 105cm wide, the maximum weight will be 120kg. For single body bed bases up to 150cm wide, the maximum weight will be 180kg. In twin bed bases, consisting of two bodies, up to 105cm wide, the maximum weight will be 120kg for each of the bodies of the bed base.

We recommend that you read all the information on the characteristics of your product as it will help you to keep your resting equipment in perfect condition.

It should be noted that any replacement covered by the product warranty will be established according to the shipping method contracted at the time of purchase. If you contracted our fast service with street delivery, the replacement will be delivered in the same way as the first shipment. If, on the other hand, you have contracted the home delivery and assembly service, the parts or products covered by the warranty will be reinstalled and the defective parts or products will be removed from your home.

13. CANCELLATION OF ORDERS

You will always have the option to cancel your order before it leaves our facilities under the following conditions:
If the order is canceled without this has begun to be manufactured, you will be credited the corresponding amount, if you have paid all or part of it, not to involve an extra cost for LARIS DESCANSO S.L. On the other hand, the order will be canceled without any payment in cases where you have not made any disbursement of money.

15. APPLICABLE LAW

The terms and conditions governing this website and all relationships that may arise are safeguarded by Spanish law. The present conditions are formulated with the intention of communicating and protecting the rights of users and customers in accordance with Law 7/98 of April 13 of General Contracting Conditions, Law 7/96 of January 15 of Retail Trade Regulation, Civil Code, Directive 2000/31 EC of the European Parliament and of the Council of June 8, Law 34/2002 of July 11 of services of the information society and electronic commerce, Royal Legislative Decree 1/2007 of November 16, which approves the Revised Text of the General Law for the defense of Consumers and Users and other applicable laws and their implementing regulations, if by any error or omission in any of these clauses could be abusive under the laws indicated will be considered not put and in the event that any conflict or discrepancy arises in the interpretation or application of these contractual conditions, the parties submit to the courts and tribunals of the domicile of the consumer.
